This study comparatively examines the dividends behavior in state-controlled firms versus family-controlled firms. With the sample of large industrial firms listed on the Main Board of Hong Kong Stock Exchange, we investigate the dividends payment rates, stability of dividends payment, the effects of firm size, profitability and growth opportunity on likelihood to pay dividends, as well as the concentration of dividend in state-controlled versus family-controlled firms. Based on the findings, we derive some ethical implications of dividends policy regarding the differences (...) in business ethical behavior, corporate social responsibility, corporate governance, business sustainability, and shareholder activism in state-controlled versus family-controlled firms, as well as the improvement in these respects through cross-listing in Hong Kong. Current workflows in academic ecology rarely allow an engagement of ecologists with philosophers, or with contemporary philosophical work. We argue that this is a missed opportunity for enriching ecological reasoning and practice, because many questions in ecology overlap with philosophical questions and with current topics in contemporary philosophy of science. One obstacle to a closer connection and collaboration between the fields is the limited awareness of scientists, including ecologists, of current philosophical questions, developments and ideas. In this article, we aim (...) to overcome this obstacle and trigger more collaborations between ecologists and philosophers. First, we provide an overview of philosophical research relevant to ecologists. Second, we use examples to demonstrate that many ecological questions have a philosophical dimension and point to related philosophical work. We elaborate on one example – the debate around the appropriate level of complexity of ecological models – to show in more detail how philosophy can enrich ecology. Finally, we provide suggestions for how to initiate collaborative projects involving both ecologists and philosophers. (shrink)

We present RAWLSNET, a system for altering Bayesian Network (BN) models to satisfy the Rawlsian principle of fair equality of opportunity (FEO). RAWLSNET's BN models generate aspirational data distributions: data generated to reflect an ideally fair, FEO-satisfying society. FEO states that everyone with the same talent and willingness to use it should have the same chance of achieving advantageous social positions (e.g., employment), regardless of their background circumstances (e.g., socioeconomic status). Satisfying FEO requires alterations to social structures such as school (...) assignments. Our paper describes RAWLSNET, a method which takes as input a BN representation of an FEO application and alters the BN's parameters so as to satisfy FEO when possible, and minimize deviation from FEO otherwise. We also offer guidance for applying RAWLSNET, including on recognizing proper applications of FEO. We demonstrate the use of our system with publicly available data sets. RAWLSNET's altered BNs offer the novel capability of generating aspirational data for FEO-relevant tasks. Aspirational data are free from the biases of real-world data, and thus are useful for recognizing and detecting sources of unfairness in machine learning algorithms besides biased data. (shrink)

Nudges have gained popularity as a behavioral change tool that aims to facilitate the selection of the sensible choice option by altering the way choice options are presented. Although nudges are designed to facilitate these choices without interfering with people’s prior preferences, both the relation between individuals’ prior preferences and nudge effectiveness, as well as the notion that nudges ‘facilitate’ decision-making have received little empirical scrutiny. Two studies examine the hypothesis that a social proof nudge is particularly effective when people (...) have no clear prior preference, either because people are indifferent (in a colour-categorization task; Study 1, N = 255) or because people experience a choice conflict (making shopping decisions about meat products; Study 2, N = 97). Both studies employed a social proof nudge to steer participants’ choices. The potential facilitating effect of the nudge was tested using a mouse-tracker paradigm that implicitly assessed experienced uncertainty during decision-making. Results showed that the nudge was effective in steering participants’ decisions; the facilitation effect (i.e., reduced uncertainty regarding the decision) was only observed for conflicting preferences, but not under indifference. A better understanding of when and how nudges can influence individuals’ behavior may help in deciding whether nudges are an appropriate policy tool for changing particular undesirable behavior. OBJECTIVE: To report and analyse the pattern of end-of-life decision making for terminal Chinese cancer patients. DESIGN: Retrospective descriptive study. SETTING: A cancer clinical trials unit in a large teaching hospital. PATIENTS: From April 1992 to August 1997, 177 consecutive deaths of cancer clinical trial patients were studied. MAIN MEASUREMENT: Basic demographic data, patient status at the time of signing a DNR consent, or at the moment of returning home to die are documented, and circumstances surrounding these events evaluated. RESULTS: (...) DNR orders were written for 64.4% of patients. Patients in pain (odds ratio 0.45, 95% CI 0.22-0.89), especially if requiring opioid analgesia (odds ratio 0.40, 95% CI 0.21-0.77), were factors associated with a higher probability of such an order. Thirty-five patients were taken home to die, a more likely occurrence if the patient was over 75 years (odds ratio 0.12, 95% CI 0.04-0.34), had children (odds ratio 0.14, 95% CI 0.02-0.79), had Taiwanese as a first language (odds ratio 6.74, 95% CI 3.04-14.93), or was unable to intake orally (odds ratio 2.73, 95% CI 1.26-5.92). CPR was performed in 30 patients, none survived to discharge. CONCLUSIONS: DNR orders are instituted in a large proportion of dying Chinese cancer patients in a cancer centre, however, the order is seldom signed by the patient personally. This study also illustrates that as many as 20% of dying patients are taken home to die, in accordance with local custom. (shrink)

The justice literature has coalesced around the notion that actors (e.g., supervisors) tend to utilize the norm of equity for resource allocation decisions because it is generally considered most fair when employees who contribute more to the organization receive more resources. Yet, actors might sometimes utilize a need norm to allocate resources to those most in need. Studies that have addressed need-based resource allocations have assumed a relatively straightforward conceptualization of need. However, research from related areas suggests that multiple characteristics (...) of the need itself could trigger actors’ use of a need norm to allocate resources. We advance a theoretical framework that outlines various need characteristics that drive actors’ use of a need norm. The framework draws on the processes outlined in attribution theory and integrates those with the content domains addressed in fairness theory. A discussion of the implications for justice, attribution, and fairness theory research follows. (shrink)

What kinds of time are opened, disclosed, or foreclosed in such moments? This section explores a concept that has a long history in rhetoric and philosophy, but which is urgently called for now, in a time that many think of as critical, catastrophic, or even apocalyptic. Changes in the economy, (...) climate, and the state of our democracies demand urgent attention, and while people disagree on the course to be taken, there is a sense that—this is it!—now is the time. The concept of kairos (from ancient Greek καιρός) comprises both a critical time and a perfect opportunity; it is the right moment to act, even though the word could also be interpreted in a more general sense as referring to the issue of right timing. Considered as "one of the most untranslatable of Greek words," kairos is perhaps related to the verb kurō, "to meet" or "meet accidentally," as when an arrow meets a target, suggesting that there is a spatial component in the temporal kairos.1 The spatial dimension shines through in the earliest uses of the term discussed in both SeungJung Kim's article on ancient Greek visual arts and Robert Sullivan's article on Isocrates (436–338 BCE). According to Sullivan's survey, Isocrates most often employs the word to refer to a specific situation, occasion, state of affairs, or set of circumstances.How do you recognize, let alone seize, this kind of moment, though? The best-known depiction of this difficulty is a portrait of Kairos personified that dates back to Lysippos in the fourth century BCE, reconstructed visually in three dimensions in Kim's essay. In Greek mythology Kairos is the god of golden opportunities, which (as we all know!) tend to pass by too quickly. The portrait shows a winged figure with a flowing forelock that ideally gives you something to hold on to. I like to imagine that if you [End Page 267] manage to arrest this passing instant, time itself comes to an abrupt halt, which throws Kairos's hair out in front of his face.Of course, people do not necessarily see it as positive when someone appears to have captured the moment. At the kairos symposium hosted by art historian Barbara Baert in Brussels in October 2018, W. J. T. Mitchell held up a picture of President Donald Trump's sculpted forelock to illustrate that it all depends on the perspective. Turning the familiar Greek portrait into an image of the opportunist, Mitchell reminded all of us that had gathered to celebrate the legacy of kairos in iconographic, philosophical, theological, semantic, historical, and anthropological studies, of the ethical issues arising in such moments. The question of moral accountability is bound to come up, whether one takes kairos to refer to the act of seizing the moment, involving some form of decision, or to the moment itself, the kairos, which some might claim just seized upon them and carried them away.As Debra Hawhee and Erik Charles White before her have argued, kairos does not seem to be confined by the subjective reason operating in a "rhetorical situation," but it depends on "the forces pushing on the encounter," in addition to instinct and intuition, and possibly on habitual impulses springing from experience (Hawhee 2002, 24–25; White 1987; reconsidered by Brod 2021). Audiences may also have a significant role to play, as Kermit Campbell underscores in his discussion of the symbiosis of call and response in African American churches and his reflection on how Martin Luther King's speech at the 1963 March on Washington replied to a call: "Tell them about the dream, Martin."The moment of kairos may appear spontaneous and deliberate, both at the same time. Cyclin-dependent kinase 5 has been implicated in Alzheimer's disease pathogenesis. Here, we demonstrate that overexpression of p25, an activator of cdk5, led to increased levels of BACE1 mRNA and protein in vitro and in vivo. A p25/cdk5 responsive region containing multiple sites for signal transducer and activator of transcription was identified in the BACE1 promoter. STAT3 interacts with the BACE1 promoter, and p25-overexpressing mice had elevated levels of pSTAT3 and BACE1, whereas cdk5-deficient mice had reduced levels. Furthermore, mice with a (...) targeted mutation in the STAT3 cdk5 responsive site had lower levels of BACE1. Increased BACE levels in p25 overexpressing mice correlated with enhanced amyloidogenic processing that could be reversed by a cdk5 inhibitor. These data demonstrate a pathway by which p25/cdk5 increases the amyloidogenic processing of APP through STAT3-mediated transcriptional control of BACE1 that could have implications for AD pathogenesis. Cambridge: Harvard UP, 1998.This essay addresses the current debates surrounding what some have labeled the Two Lefts: a “cultural left” and an activist left. 1 Debate over this “divide” has made many strange bedfellows, but perhaps none quite so unheimlich as “liberal leftist” Richard Rorty and cultural conservative Harold (...) Bloom. To be sure, Rorty has often alluded to Bloom’s work, especially Bloom’s notion of “strong poets,” but in his most recent book, Rorty has appropriated Bloom in a particularly telling manner. In 1994, Harold Bloom published his polemic The Western Canon. At once eloquent and pathetic, it pressed all the right buttons. Bloom succinctly (or shall we say, reductively?) deployed his version of the “aesthetic” against any other approach. Cultural conservatives were gratified that someone of Bloom’s stature had done them the service of voicing their interests in a highly visible and contestatory manner; more moderate sorts squirmed uncomfortably at Bloom’s unabashed elitism and the shrillness of his tone; theorists and cultural studies folks were outraged at Bloom’s absolute ignorance of their work and his resort to parody instead of anything vaguely resembling an engaged critique; and ethnic, minority, queer, and feminist critics had more than enough to be insulted by in his racist and sexist arrogance. So far out is Bloom’s jeremiad that it probably came close to realizing his worst nightmare—it may have driven students screaming into all those horrid cultural studies classes to find out what was so seductive, so powerful as to corner The Canon. So I didn’t worry too much about The Western Canon. That is, until I read Richard Rorty’s essay “The Inspirational Value of Great Works of Literature” and its companion pieces in Achieving Our Country: Leftist Thought in Twentieth-Century America. What was Rorty, a self-proclaimed leftist, doing, calling to his aid the social and cultural archconservative Harold Bloom?In the first part of my essay I ponder this strange alliance, particularly as it joins forces against ethnic studies (to be sure, its common target is more generally “theory” of any stripe or color, but I want specifically to address the issue of ethnic literary study). Rorty adapts Bloom’s School of Resentment to characterize what he calls a certain, bad “knowingness,” against which he poses “hope” and “inspiration.” I want to examine more closely the nature and content of that destructive “knowledge,” for it becomes clear that [End Page 37] this knowledge is for Rorty the recognition of Otherness as a politically (as opposed to “merely” ontologically) functional identity. This knowledge is disturbing to Rorty and deeply informs his notions of “patriotism” and Americanism. For him, such knowledge impedes the formation of a leftist politics. It is precisely the disjunction between the “knowing” discourse of the cultural left obsessed with identity politics and an activist political left (modeled after the old reformist left) that troubles Rorty.My essay will be largely devoted to showing how Rorty’s recent work develops his earlier work on “ethnocentrism” into an “Americanism” that erodes precisely the liberal foundations of that earlier work and discloses the weakness of its claims. I understand this development as compelled by a certain impatience with identity politics that is shared by a number of liberal and leftist critics of American political society, an impatience fueled perhaps not so much by a conservative threat as by a perceived threat from “within” progressive politics. Basically, I ask, how and why are knowledge and recognition of “difference” taken to immobilize progressive politics? To frame that same question in a slightly different manner—what is the presumed content of that “progressive” politics, and what assumptions do we have to make in order to arrive at that point of view?Against the rather odd Bloom/Rorty pairing, set against “knowledge,” one would naturally seek out an enemies list for possible allies. Both are scholars for whom I have enormous respect.Jones follows a certain trajectory through my work, and I think she is absolutely right to articulate it as a dominant motif. Yet as (...) she also points out, in keeping with this very motif, to which I will return, in identifying this as a thematic strand she is at risk of suppressing other tracks that might have been mapped out. Let me begin, then, by taking up the invitation she thereby offers, by briefly indicating another path through my work as I see it, articulated less through theoretical inflection, less schematically, a path that maps itself by way of affective sites of investiture. So much of our theoretical enquiry is undergirded by affective attachments, created by the accidents of history—where, when, and in what circumstances we were born—through the contingent experiences we happen to have had and the pedagogical influences to which we happened to have been exposed, to the particular wounds life inflicts upon us, and to the particular happiness or solace it grants us, to our friendships, to those we have loved and to those we come to love.I embrace Fradinger’s suggestion that I am something of a radical democrat. So too the quasi-Levinasian sense of the necessity to be open to relationality and answerable to the interlocutor resonates with me, the difficult work of being called to account for what I would call the imaginary (rather than the representations) to which one finds oneself perhaps unconsciously beholden. No matter how adept I might be at deconstructing texts and ideas, no matter how well versed I might be in theory, when it comes to myself, so often, it seems, I find myself stuck, endlessly playing out the same story. I think this can be parsed out in terms of affective attachments; I do not think I am the only one to have discovered so many times that I have been profoundly wrong about profoundly important things.It is as if before we know it, we discover that we have played out a script—whether it is psychic, familial, or cultural—that has effectively locked us into a Hegelian master-slave narrative. Sometimes it is as if all any of us can ever do is robotically repeat such scenarios, as if we can never achieve anything beyond flipping the narrative, as if we cannot manage to intervene in the narrative itself, no matter how many theories we are armed with. It is as if, time and time again, we trundle along the same grooves that have been etched out for us by some narrative over which we cannot seem to achieve control. There is something automatic, perhaps unconscious, about these scripts to which we discover ourselves to have adhered, despite our best intentions, despite the fact that we know better, despite all our theoretical insights.It is as if your vision is habituated to a particular scenario, and no matter what you do, it simply keeps repeating itself, taking you by surprise each time. Then something happens, and the details start to compile themselves into another narrative, one that was there all the time, but that you didn’t, you couldn’t, wouldn’t allow yourself to see, to imagine. Only in retrospect do you begin to piece together the signs, to accord significance to the details you somehow managed to dismiss as insignificant, as failing to contribute any coherence or salience.
